1. Acceptance of Terms
By accessing or using software, products, or services provided by Palms AI, LLC ("Palms AI," "we," "us") — including SudsScheduler and any future products — you agree to be bound by these Terms of Service.
2. Description of Service
Palms AI develops and operates software products for small service businesses. Our flagship product, SudsScheduler, is a scheduling and SMS appointment-confirmation platform for cleaning service companies. Additional products are in development.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must promptly notify us of any unauthorized use.
4. Acceptable Use
You agree not to: (a) use our services for any unlawful purpose; (b) attempt to gain unauthorized access to any portion of our services; (c) interfere with or disrupt our services; (d) copy, modify, or distribute any part of our services without our written consent.
5. Data and Privacy
Your use of our services is governed by our Privacy Policy (below). By using our services, you consent to the collection and use of your data as described therein.
6. Subscription and Billing
Some products may be offered as paid subscriptions. Pricing and billing terms will be communicated before any charges apply. You will not be charged without your explicit consent.
7. Disclaimer of Warranties
Our services are provided "as is" without warranties of any kind, either express or implied. We do not warrant that the services will be uninterrupted, error-free, or completely secure.
8. Limitation of Liability
To the maximum extent permitted by law, Palms AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of our services.
9. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated in advance. Continued use of our services after changes take effect constitutes acceptance of the revised Terms.

Privacy Policy

1. Information We Collect
We collect information you provide when creating an account or using our products, such as name, business name, email address, and phone number. We also collect data you enter while using the service (e.g. appointments, clients) and standard technical data such as IP address, browser type, and usage logs.
2. How We Use Your Information
We use your information to: (a) provide and maintain our services; (b) process scheduling and appointment confirmations; (c) send SMS confirmations on your behalf (see Section 6); (d) improve our services; (e) communicate with you about the service.
3. Data Storage and Security
Data is stored in secure, managed cloud infrastructure (Supabase, Vercel) with industry-standard encryption in transit (TLS 1.3) and at rest (AES-256).
4. Data Sharing
We do not sell your data. We share data only with service providers who help us operate our services (e.g. Supabase, Vercel, Mapbox, Telnyx) and only as required by law or legal process. Client information you enter is your business data; you are responsible for ensuring you have appropriate consent to store and use your clients' information.
5. Your Rights
You have the right to: (a) access your data; (b) correct inaccurate data; (c) export your data; (d) delete your account and data; (e) opt out of non-essential communications. To exercise these rights, contact mike@palmsai.io.
6. SMS Communications
When SMS features are enabled in a Palms AI product (such as SudsScheduler), we send appointment confirmation and reminder text messages to your clients on your behalf via our SMS provider (Telnyx). Recipients can opt out at any time by replying STOP and can request help by replying HELP. Message frequency varies by appointment activity (typically 1–3 messages per appointment). Message and data rates may apply. Mobile phone numbers and SMS opt-in consent are used solely to deliver these appointment messages and are never sold or shared with third parties for their own marketing. You, as the business operator, are responsible for obtaining and maintaining recipient consent for the numbers you add to a Palms AI product.
7. Data Retention
We retain your data for as long as your account is active. Upon account deletion, your data is permanently removed within 30 days, except where retention is required by law.
8. Children's Privacy
Our services are not directed to children under 13, and we do not knowingly collect personal information from children under 13.
9. Changes to This Policy
We may update this Privacy Policy from time to time. Material changes will be communicated in advance.
